These General Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the bijouxespresso.com website

The user is required to read these General Conditions of Sale which are considered generally and unequivocally accepted at the time of purchase.

The user is invited to download and print a copy of the purchase form and these General Conditions of Sale.

Scope of
The following General Conditions of Sale apply to orders of products present on the bijouxespresso.com website in the version published at the time of the order.

These General Conditions of Sale constitute an integral part of the contract stipulated between bijouxespresso and the customer. Provisions differing from the General Conditions of Sale are legally binding only if expressly accepted in writing by bijouxespresso.

The offer of products and services on the bijouxespresso.com website is addressed exclusively to natural persons and legal entities who do not trade in them as part of the operation of a company; therefore bijouxespresso reserves the right to refuse orders placed by such parties.

These General Conditions of Sale regulate the offer, forwarding and acceptance of purchase orders for products on bijouxespresso.com and do not, however, regulate the supply of services or the sale of products by parties other than seller who are present on the same site via links, banners or other hyperlinks.

Before placing orders and purchasing products and services from different parties, we suggest checking their conditions of sale, for which, in any case, the company Bijoux Espresso di Laura de Santis cannot be held responsible in any way

Conclusion of the contract
To conclude the purchase contract, it will be necessary to complete the form in electronic format and send it following the relevant instructions.

It contains the reference to the General Conditions of Sale, the images of each product and the relative price, the means of payment that can be used, the delivery methods of the purchased products and the relative shipping costs and indicative delivery times, a I refer to the conditions for exercising the right of withdrawal; methods and times for returning purchased products.

Before concluding the contract, you will be asked to confirm that you have read the General Conditions of Sale including the information on the right of withdrawal and the processing of personal data.

The contract is considered concluded when the seller receives the form completed by the user. The seller, having verified the data contained therein, may, at its sole discretion, refuse the order.

The buyer will be obliged to pay the price from the moment the online order submission procedure is completed. This will happen by clicking on the "CONFIRM ORDER" button at the end of the guided procedure.

Once the contract is concluded, the seller takes charge of the order for its fulfillment.

Registered users
When completing the registration procedures, the user undertakes to follow the instructions on the site and to provide their personal data correctly and truthfully.

The confirmation will in any case exempt bijouxespresso from any responsibility regarding the data provided by the user. The user undertakes to promptly inform bijouxespresso of any change in their data communicated at any time.

If the user then communicates inaccurate or incomplete data or even in the event that there is a dispute by the interested parties regarding the payments made, bijouxespresso will have the right not to activate or suspend the service until the relevant deficiencies have been rectified.

Upon the user's first request to activate a profile, bijouxespresso will assign the same username and password. The latter recognizes that these identifiers constitute the system for validating the user's access to the Services and the only system suitable for identifying the user that the actions carried out through such access will be attributed to him and will have binding effect on him.

The user undertakes to maintain the secrecy of his access data and to keep them with due care and diligence and not to transfer them, even temporarily, to third parties.

Buyer's obligations
By sending his purchase order electronically, the buyer declares that he is an adult, that the data provided are true and that he has unconditionally accepted these conditions of sale, undertaking to observe them without reservation. The customer will hold bijouxespresso relieved and free from liability arising from the issuing of incorrect documents due to incorrect data provided by the customer.

Product availability
Product availability refers to the actual availability at the time the buyer places the order. This availability must however be considered purely indicative because, due to the simultaneous presence on the site of multiple users, the products could be sold to other customers before the order is confirmed.

Even after sending the order confirmation email, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically corrected with the elimination of the unavailable product and the buyer will be immediately informed via e-mail.

If the buyer requests cancellation of the order, terminating the contract, bijouxespresso will refund the amount paid within 15 days from the moment in which bijouxespresso became aware of the buyer's decision to terminate the contract.

Products offered
The photographs illustrating the products are indicative and therefore not binding. The texts that accompany them are the reproduction of the information appearing on the packaging or warnings for use of the respective manufacturers. The differences between the photographs and the products themselves may only be minimal differences and do not concern the essential characteristics of the products. The color of the products featured on the bijouxespresso.com website may be different from the color of the actual product.

Prices
All prices displayed include VAT and delivery costs are the responsibility of the buyer. The price is the one highlighted on the site at the time of the order, without consideration of previous offers or subsequent price changes, therefore the prices of the products published from time to time cancel and replace the previous ones.

bijouxespresso reserves the right not to process orders received from users who are not classified as "Consumers".

Terms of payment
Once you have selected the desired products, they will be added to the cart. Simply follow the purchase instructions, entering or verifying the information requested at each step of the process. Order details may be modified before payment.

bijouxespresso accepts payments made in the following way:

- Immediate payment with PayPal account;

- Immediate payment via credit card and prepaid cards (e.g. Postepay);

- Payment by advance bank transfer;

Billing
The transactions are subject to the regime established for mail order sales and daily sales fees, including VAT, are recorded in the fee register.

The User who wishes to receive the invoice must communicate this in advance by email to info@bijouxespresso.com or by telephone at +39 338 34 84 675. It will then be necessary to provide the billing data.

Transportation and delivery

bijouxespresso will only make deliveries to the user's home, provided at the time of purchase.

Delivery is generally carried out within 2-5 working days, or, if no delivery date is specified, within the time estimated at the time of selecting the delivery method and, in any case, within the maximum period of thirty days from the date of confirmation.

If delivery is not possible, the order will be sent to the warehouse. In this case, a notice will specify where the order is located and how to agree on a new delivery.

If you are unable to be present at the delivery location at the agreed time, we ask you to contact us again to agree a new delivery date.

If the buyer cannot be present at the delivery location at the agreed time, he will have to contact the seller again to agree on a new delivery date.

If, after thirty days from the date on which the order is available for delivery, delivery cannot take place for reasons not attributable to the seller, the contract will be considered terminated due to the fault of the buyer.

All shipping costs are the responsibility of the buyer and are explicitly highlighted when placing the order.

Passing of risk
The risks relating to the products will pass to the buyer from the moment of delivery of the goods to the carrier. Ownership of the products is considered acquired upon receipt of full payment of all amounts due in relation to them, including shipping costs.

Warranty and commercial compliance
The seller is responsible for any defect in the products offered on the site in accordance with the provisions of Italian law.

If the buyer has stipulated the contract as a consumer, i.e. any natural person who acts on the site for purposes unrelated to any entrepreneurial or professional activity carried out, this guarantee is valid provided that the defect appears within 12 months from the date of delivery of the products, that the buyer presents a formal complaint regarding the defects within a maximum of 8 days from the date on which the defect was recognized by the latter and that the online return form is correctly filled out.

In the event of non-conformity of the product, the buyer who has stipulated the contract as a consumer will have the right to obtain the restoration of conformity of the products without charge, through repair or replacement, or, if the buyer decides to retain the product, to obtain an appropriate price reduction or, in the event of impossibility of repair or replacement, the refund of the price limited to the non-compliant product.

All return costs for defective products will be borne by the seller.

Withdrawal
In accordance with the legal provisions in force, the buyer has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days pursuant to art. 57 of Legislative Decree 206/2005 starting from the date of receipt of the products.

In the case of multiple purchases made by the buyer with a single order and delivered separately, the 14-day period starts from the date of receipt of the last product.

The user who intends to exercise the right to withdraw from the purchase can do so by sending an email, indicating the desire to withdraw from the purchase, the order number and his name, to the following email address: shop@bijouxespresso.com

The buyer must exercise the right of withdrawal also by sending any explicit declaration containing the decision to withdraw from the contract or alternatively transmit the standard withdrawal form, referred to in Annex I, part B, non-mandatory Legislative Decree 21/2014.

The User is responsible for the integrity of the Product as long as the same good is in his possession and must take all appropriate measures to preserve the Product and do everything possible to ensure that the Product is returned in the best possible condition.

bijouxespresso will not consider return requests in the event that the returned Product is malfunctioning due to improper use, negligence, physical, aesthetic or superficial damage or alterations, tampering or improper maintenance or wear and tear.

The goods must be returned intact, in the original packaging, complete in all its parts and complete with the accompanying documentation. Without prejudice to the right to verify compliance with the above, the site will refund the amount of the products subject to the withdrawal within a maximum period of 30 days, including any shipping costs incurred during the order phase.

The costs for returning the item to bijouxespresso are the responsibility of the buyer. We recommend that you be careful to provide a tracking number. We cannot be responsible for lost or undelivered orders without identification and tracking. If we do not receive delivery of the package within 20 days of the withdrawal request, bijouxespresso reserves the right to refuse the refund request.

As required by the art. 56 paragraph 3 of Legislative Decree 206/2005, modified by Legislative Decree 21/2014, the site may suspend the reimbursement until receipt of the goods or until the buyer demonstrates that he has sent the goods back.

The right of withdrawal will not apply if the bijouxespresso services and products are included in the categories of the art. 59 of Legislative Decree 206/2005.

The site will carry out the refund using the same payment method chosen by the buyer during the purchase. If this method is not possible, the refund can be made by bank transfer, and in any case the buyer who intends to exercise his right of withdrawal must provide the bank details: IBAN, SWIFT and BIC necessary to make the refund.

Data processing
The buyer's data are processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the specific section containing the information pursuant to art. 13 EU Regulation 2016/679 (Privacy Policy).

Safeguard clause
In the event that one of the clauses of these General Conditions of Sale is void for any reason, this will in no case compromise the validity and compliance with the other provisions contained in these General Conditions of Sale.

Applicable legislation
The sale of products and services via electronic means is governed by articles 45 to 67 "Consumer rights" of Legislative Decree no. 6 September 2005. 206 (Consumer Code) and by Legislative Decree 9 April 2003 n. 70 regarding electronic commerce. The sales contract stipulated between bijouxespresso and the Customer will be governed and interpreted in accordance with Italian law.

Jurisdiction
Any disputes inherent and/or consequent thereto must be resolved exclusively by the Italian jurisdictional authority. In particular, if the buyer qualifies as a Consumer, any disputes must be resolved by the court of the place of domicile or residence of the buyer according to the applicable law.
